These Terms & Conditions ("Terms") govern your use of the digivolt.in website and any services engaged through DIGIVOLT, a digital marketing practice run by Chandrasekar MG (also known as Lion Chandru), based in Chennai & Tirupattur, India. By using this website or engaging my services, you agree to these Terms.
1. Services Offered
DIGIVOLT provides digital marketing services including but not limited to:
- Business website design, development, and maintenance
- E-commerce website design, development, and maintenance
- Google Business Profile creation and optimization
- Social media management
The specific scope, timeline, and deliverables for any project are agreed separately in writing (via email or a signed proposal/quote) before work begins.
2. Engagement Process
A typical engagement follows this process:
- Initial consultation to understand your requirements
- A written quote or proposal outlining scope, timeline, and cost
- Written agreement (email confirmation is sufficient) before work begins
- Project execution, with regular check-ins
- Delivery, review, and handover
3. Payment Terms
- Payment terms (including any advance/deposit, milestone payments, or full payment on delivery) will be specified in your project quote.
- Invoices are due within the timeframe stated on the invoice, unless otherwise agreed in writing.
- Late payments may result in a pause of ongoing work until the account is settled.
- Prices for ongoing services (e.g. maintenance, social media management) may be revised with advance notice ahead of a renewal period.
4. Client Responsibilities
To keep your project on schedule, you agree to:
- Provide content, assets, access credentials, and feedback in a timely manner
- Respond to review requests within a reasonable time
- Ensure you have the rights to any content, logos, or images you provide for use in your project
5. Intellectual Property
- Ownership of final deliverables (e.g. website code, designs) transfers to you upon full payment, unless otherwise agreed in writing.
- I retain the right to showcase completed work in my portfolio, case studies, and marketing materials, unless you request confidentiality in writing (e.g. under an NDA).
- Any third-party tools, plugins, themes, or licensed assets used in your project remain subject to their own licensing terms.
6. Revisions & Change Requests
Each project quote includes an agreed number of revision rounds. Requests that fall outside the originally agreed scope (scope creep) may incur additional charges, which will be communicated and agreed before extra work begins.
7. Confidentiality
Any confidential business information you share with me during a project will not be disclosed to third parties, except as required to deliver the agreed services (e.g. sharing assets with a hosting provider).
8. Warranties & Disclaimers
- Services are delivered with reasonable skill and care, based on current best practices at the time of delivery.
- I do not guarantee specific search engine rankings, follower counts, traffic numbers, or sales outcomes, as these depend on factors outside my direct control (search engine algorithms, market conditions, platform policies, etc.).
- Websites and stores are tested before handover, but I am not liable for issues arising from third-party services (hosting, payment gateways, plugins) after handover, unless covered under a separate maintenance agreement.
9. Limitation of Liability
To the extent permitted by law, DIGIVOLT's liability for any claim arising from services provided is limited to the amount paid for the specific service giving rise to the claim. DIGIVOLT is not liable for indirect, incidental, or consequential damages, including loss of profits or business opportunities.
10. Termination
Either party may terminate an ongoing engagement with written notice. Work completed up to the termination date will be invoiced and is payable. Any advance payments for work not yet started may be refunded at my discretion, minus any costs already incurred.
11. Governing Law
These Terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Chennai, Tamil Nadu.
